Terms of use
This translation is provided for convenience. Only the German version is legally binding. German original: Nutzungsbedingungen.
1. Provider and scope
The service EZ Poker at https://poker.techspace.de, also reachable at https://ez-poker.apps.01.cf.eu01.stackit.cloud (the “service”), is provided by Techspace Software GmbH, Am Eckle 26, 77723 Gengenbach, Germany (“we”). These terms apply to every use of the service. By creating or entering a room you agree to them.
2. Conclusion of the contract
By clicking “Create room” or opening a room link, a free-of-charge contract of use is concluded between you and us for the duration of your use of the room. Apart from choosing a card there are no inputs; you can change your card at any time until the reveal. The language of the contract is German. We do not store the text of the contract; these terms can be called up at any time at /terms and can be printed or saved. An English reading version of these terms is available at /terms/en; only the German version is binding. We have not submitted to any codes of conduct.
3. Service
The service is a free tool for agile estimation with the cards ½, 1, 2, 3, 5, 8, 13 and 21. Anyone who knows the link to a room can enter it. Participants receive a random name; there are no free-text inputs. Rooms are deleted automatically no later than 4 hours after they were created. Voting results are not stored and cannot be restored.
We provide the service free of charge and without any promise of a particular availability, performance or fitness for a particular purpose. We may change, restrict, temporarily interrupt (e.g. for maintenance) or entirely discontinue the service at any time. There is no entitlement to use it.
How the service meets the accessibility requirements is described on the page Accessibility (§ 14 BFSG).
4. Rules of use
In particular, it is not permitted
- to disrupt or overload the service or to circumvent security mechanisms (e.g. mass automated rooms or connections),
- to enter or disrupt other people’s rooms without authorisation,
- to use the service for unlawful purposes.
Share the link to a room only with people who are meant to take part: anyone with the link can enter the room and see the votes. The service is not suitable for secret ballots or legally binding votes. Whether its use in your organisation is permissible (e.g. under internal policies or in the context of employee co-determination) is your or your organisation’s own responsibility.
To protect the service we automatically limit the number of rooms and connections per network address and in total. In the event of violations we may additionally block individual connections or networks. No further moderation of content takes place, because users cannot post any content other than choosing a card. Please send notices of abuse or unlawful use electronically to info@techspace.de; please state what it is about and, where possible, when it happened. We will confirm receipt and inform you of our decision.
5. Liability
(1) We are liable without limitation for intent and gross negligence, for damage arising from injury to life, body or health, under the German Product Liability Act, for fraudulently concealed defects, under a guarantee we have given, and insofar as mandatory statutory provisions, in particular Art. 82 GDPR, provide for liability.
(2) Otherwise, in cases of slight negligence we are liable only if we breach a material contractual obligation whose fulfilment makes proper use of the service possible in the first place and on whose observance you may regularly rely, and then only for the foreseeable damage typical for this kind of contract at the time the contract was concluded.
(3) Insofar as the law provides a further limitation of our liability for services provided free of charge, that limitation remains unaffected.
(4) Storing voting results is not part of the service. For data lost through the expiry of a room, a restart or a fault we are liable only in accordance with paragraphs 1 to 3.
(5) The above provisions also apply in favour of our legal representatives, employees and vicarious agents.
6. Data protection
Which data is processed is set out in the privacy policy.
7. Changes
We may change these terms with effect for the future. The version published on this page at the time a room is created or entered applies.
8. Consumer dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.
9. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the state of their habitual residence. If the user is a merchant (Kaufmann), a legal entity under public law or a special fund under public law, the place of jurisdiction is the registered office of Techspace Software GmbH (Gengenbach). Should any provision be invalid, the remaining provisions remain valid.
